Conditions générales d’Amandé Studio Sàrl

Introduction

Welcome to Amandé Studio (the “Studio”).

For the purposes of these Terms and Conditions, “Customer” means any person who creates an account, purchases a session, class pack or membership, makes a booking, or otherwise uses the services, facilities or equipment of the Studio.

By creating an account, purchasing a session, class pack or membership, or making a booking, the Customer confirms that they have read, understood and accepted these Terms and Conditions. These Terms and Conditions form an integral part of any contractual relationship between the Customer and the Studio.

The Studio may update these Terms and Conditions from time to time. The version in force at the time of purchase applies to that purchase. For ongoing memberships, changes will be notified to the Customer in advance by appropriate means. Changes required by applicable law, regulatory requirements, safety considerations or circumstances beyond the Studio’s reasonable control may take effect immediately or on such other date as reasonably determined by the Studio.

Prices and Bookings

Prices are displayed in Swiss francs on the Studio’s website and booking platform and include VAT where applicable. Payment is due at the time of purchase or, for memberships, in accordance with the payment terms displayed at checkout. The Studio may refuse or suspend bookings if payment is outstanding. Any fees, charges or payment obligations already incurred remain due notwithstanding any suspension of the Customer’s account or access to the Studio.

Sessions must be booked in advance and are subject to availability. A purchase does not guarantee a particular date or time. The Studio does not guarantee the availability of any particular session, programme, equipment or time slot.

Cancellations and Waitlists

The Customer may cancel or reschedule a booking up to 12 hours before the session starts. In case of cancellation less than 12 hours before the session or failure to attend, one session credit will be deducted from the relevant pack or membership allowance. No refund, credit or extension will be due in respect of such late cancellation or failure to attend, except where required by mandatory law. Three or more late cancellations or missed bookings within a calendar month may lead to booking restrictions for unlimited members.

If the Studio cancels a session, it will return the session credit or offer to reschedule. If the Customer joins a waitlist, the Studio asks that they retract themselves when they can no longer attend. Once the Customer is allotted a spot, the usual cancellation policy applies.

A late arrival will not extend the reserved session. The Studio may refuse entry if a Customer arrives too late to use the equipment safely or complete the session within the reserved time. The booking may then be treated as a late cancellation. The Studio shall have sole discretion, acting reasonably and having regard to safety considerations, to determine whether the Customer may participate in the remaining session.

The Studio reserves the right to refuse entry, end a session, suspend an account or terminate a membership where a Customer behaves inappropriately, breaches these Terms and Conditions, misuses equipment or places any person or property at risk, or otherwise fails to comply with any reasonable health, safety or operational instruction given by the Studio. In such cases, the affected session will not be refunded or credited back. If a membership is terminated by the Studio, any membership fees already paid for periods after the effective termination date will be refunded on a pro rata basis, unless the termination results from a serious breach by the Customer, in which case the Studio may retain such amounts to the extent permitted by applicable law.

Sessions, Packs and Memberships

Sessions and packs have the validity period stated at purchase. The Discovery Offer includes three sessions valid for 14 days. Single Movement, Strength and Recovery sessions are valid for one month; five-session Movement and Strength packs for two months; and ten-session packs for four months.

Memberships provide four, eight or unlimited sessions per month, depending on the option purchased, and have a three-month minimum commitment. Following the minimum commitment period, memberships continue on a month-to-month basis unless terminated in accordance with the cancellation terms communicated at the time of purchase. Unlimited membership allows a maximum of one session per day. Unused monthly sessions do not carry over. Sessions, packs and memberships are personal and cannot be shared or transferred. Expired or unused sessions are not refunded or extended, except where legally required or agreed by the Studio.

The Studio may temporarily modify its opening hours, timetable, available equipment or programmes where reasonably necessary for maintenance, safety, staffing, operational reasons or circumstances beyond its reasonable control. Such changes do not entitle the Customer to a refund or extension, unless they materially prevent the Customer from using the services purchased for a significant period.

Gift Vouchers and Referral Credit

If offered, gift vouchers and referral credits are subject to the conditions stated when issued. These cannot be exchanged for cash or transferred to another person.

How Sessions Work

The Studio offers private, self-guided sessions using on-screen workouts. There is no instructor leading the session. The Customer acknowledges and accepts that Studio personnel may not be present in the training area to supervise, monitor or correct the Customer’s movements or use of the equipment. The Customer therefore acknowledges that the sessions are autonomous and that they are responsible for choosing a workout and level suitable for their health, fitness and experience. The Customer must not attempt any exercise, movement, resistance level or use of equipment that they do not understand or do not feel able to perform safely. The Customer must follow the equipment and on-screen instructions and must stop exercising immediately in case of pain, discomfort, dizziness, unusual symptoms or any doubt as to whether they can safely continue. If the Customer is unsure how to use any equipment safely, they must refrain from using it and seek assistance from the Studio before continuing.

Health and Safety

Exercise, including Reformer Pilates and strength training, carries a risk of injury. If the Customer is pregnant, recently postpartum, injured, unwell, recovering from surgery or has any medical condition or other circumstance that may affect their ability to exercise safely, the Customer must not participate in any Studio activity unless and until they have obtained appropriate medical advice or approval confirming that such participation is suitable for them. The Customer is responsible for assessing, before each session, whether their health and physical condition allow them to participate safely and for informing the Studio of any circumstance relevant to the safe use of the Studio’s facilities or equipment. The Studio further requires that the Customer stop exercising if they experience pain, dizziness or other concerning symptoms, and promptly inform the Studio of any damaged equipment.

The Customer must read and sign the Studio’s separate Liability Waiver before their first session. To the fullest extent permitted by applicable law, the Studio shall not be liable for any injury, illness, death, loss or damage resulting from (i) the inherent risks of physical exercise, (ii) the Customer’s failure to comply with instructions or safety requirements, (iii) misuse or unauthorised use of equipment, (iv) the Customer’s selection of an exercise, level, resistance or intensity unsuitable for their health, fitness or experience, or (v) participation contrary to medical advice.

Nothing in these Terms and Conditions excludes or limits any liability of the Studio that cannot validly be excluded or limited under applicable Swiss law.

Studio Policies

Customers may be held responsible for damage caused by deliberate acts, negligent misuse of equipment or failure to follow instructions, excluding ordinary wear and tear. In such cases, the Studio may charge the Customer reasonable repair or replacement costs and any other reasonable costs directly resulting from such damage.

  • Appropriate footwear: Clean indoor trainers must be worn for Strength sessions where required. Outdoor shoes must be removed in designated shoe-free areas.

Data Protection

The Studio processes personal data, including account, booking, payment and communication data, in accordance with applicable Swiss data protection law and the Studio’s privacy notice, as amended from time to time. The privacy notice provides further information regarding the categories of personal data processed, the purposes of processing, disclosures to third parties and the Customer’s applicable rights.

Third-party booking, payment and technology providers may process personal data in connection with the provision of their services, in accordance with applicable law and their respective privacy notices.

Applicable Law and Jurisdiction

These Terms and Conditions and any contractual relationship between the Customer and the Studio are governed by the substantive laws of Switzerland.

Subject to any mandatory place of jurisdiction under applicable law, the courts at the registered seat of the Studio shall have exclusive jurisdiction.
